Sugaholic Bake Shop Reserves its right to take legal steps against users who create problems or possible damages of any kind, or infringe the intellectual property rights of third parties or act inconsistently with the User Agreement.
Withdrawal of Access and/or Membership
Sugaholic Bake Shop may limit, suspend or withdraw your membership and / or your access to the Site at any time, without notice, for any reason, including without limitation, breach of these Terms and Conditions.
Limitation of Liabilities
Sugaholic Bake Shop , its officers, employees, agents and suppliers shall not be liable for any loss or damage whatsoever whether direct, indirect, incidental, special, consequential or exemplary, including but not limited to, losses or damages for loss of profits, goodwill, business, opportunity, data or other intangible losses arising out of or in connection with your use of the Site, or its services or this Terms and Conditions.
Indemnity
You agree to indemnify and hold Sugaholic Bake Shop and its officers, employees, agents and suppliers harmless from any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs and expenses (including reasonable legal costs and expenses)
Loyalty Points
Loyalty Points Program is governed by Sugaholic and is Subject to Change without Prior Notice. Loyalty points program cannot be combined with other offers. Loyalty points cannot be converted to Cash or transferred to another account. Loyalty points are exclusively for purchases made on sugaholic.com. Purchases made in Store or on any other platform cannot be awarded any loyalty points. We reserve the right to change, cancel or revoke this program at anytime without prior notice. Loyalty Points are not applicable on discounted items or any promotional code. Loyalty points expire in 1 year from the date of transaction. Loyalty points are awarded on pre vat purchases of eligible products. No points are awarded on Delivery Charges. Minimum of 1000 Points are required to redeem against orders. Minimum Cart Value is assigned to each Promo Code. Sugaholic reserves the right to cancel or amend any policies pertaining to loyalty points.
Product
All Products depicted, pictured and sold on Sugaholic.com and any of its community pages are made by Sugaholic only.
Certain product may contain allergens or ingredients that may not suit a particular diet. For any information on our products please contact us.
All Products are subject to availability, we reserve the right to cancel or replace the product with a product of a equivalent quality and value.
In an event we are unable to supply your order a refund will be issued.
Products may look different in images than when received. Images on the website are for product illustration purposes only.
Product prices could be different from prices at the store or other third party websites.
Payment
You will be given clear instructions to navigate the order process and will be required to provide us with your complete personal details, together with those of the intended recipient and all necessary payment details.
We accept payment by most major credit and/or debit cards, other than Diners and American Express, department store cards and any other credit and/or debit cards as we may specify from time to time.
By clicking on the 'Pay Now' button at the end of the order process, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the sugaholic.com Website.
Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.
Delivery
Some delivery services are subject to availability.
Some delivery services may be withdrawn without notice during busy periods.
Some delivery cut off times may vary without notice during busy periods.
At certain times of the year delivery prices may vary.
Delivery charges displayed on the website are based on location. Kindly ensure correct location and full address is mentioned. In case of any error, Sugaholic will inform you of additional charges to be paid.
Delivery cannot be done at an exact time. The time range provided is the best case scenario. We shall not be liable for any failure to perform in our obligations where such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.
To avoid problems or delays with delivery, please ensure that you have included the full address details of the intended recipient and telephone number, together with your daytime contact telephone number or email address so that in the event of any delivery problems being encountered.
Sugaholic will not be liable for any damage to the product once handed over. The recipient is expected to check the order before accepting the goods. In case the recipient is not available at the venue, Sugaholic will handover the cake to the authorized person as communicated by the client.
Order Acceptance
Sugaholic Bake Shop reserves the right, at its sole discretion, to refuse or cancel any order made at Sugaholic Bake Shop for any reason whatsoever. Unavailability of stocks, errors in pricing or product information or unlawful transactions may result in the order being cancelled. We’ll keep you updated if any one of the product(s) you ordered may fall under the above criteria or if additional information is required to accept the order. If your order is cancelled after your credit card has been charged, the same amount will be credited to your credit card. Please refer to our refund and exchange policies to know more.
Order Cancellations by the Customer
Any Cancellations or changes will not be accepted within 48 hours of Delivery date.
Any Cancellations or Changes will be accepted on the sole discretion of Sugaholic Bakeshop.
No Refunds will be issued for any order. Only a Credit note may be issued
Product Images and Specifications
The images referenced, made accessible or made available to you on Sugaholic Bake Shop are for illustrative or viewing purpose only. Product images are subject to change without any prior notification. Sugaholic Bake Shop cannot guarantee that the product you receive should come in the same packing as seen on the website. However, we try to maintain accurate information and exact image of the product you may or wish to buy.
Unlawful Transactions
Sugaholic Bake Shop reserves the right to recover the cost of products, collection charges and lawyers’ fees from persons using the Website fraudulently. Sugaholic Bake Shop reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or acts
Payment by Credit Card
Sugaholic Bake Shop reserves the right to cancel/block any order where we believe that the cardholder is not the actual recipient. In such cases, the cardholder can email us at info@sugaholic.com with a scanned copy of the cardholder's Emirates ID with a statement on who can claim the product you purchased with your card.
Returns
Sugaholic Bake Shop will not accept any returns for any products sold on its website or in store. Goods once sold will not be returned or exchanged.
